Confession after termination of labour contract

Employee and employer both agreed that the labour contract should be terminated. The employer would pay 60.000 euro to terminate the contract and the employee would leave the firm within one month.

The case was presented at the court and the judge approved the termination of the contract, as the parties both agreed to the terms.

One month after the decision of the court, the employee confessed to the employer that he cheated on him. The employer told that he stole 5000 euro form him a couple of years ago.

This confession led to the situation that the employer went to the court again. He told the judge that if he would have known that the employee stole from him, he wouldn't have paid him 60.000 euro. He would have fired him on the spot instead.

 

The judge agreed that if these circumstances were known before the outcome of his decision would have been different. The judge withdraw his decision and requested both the employer and employee to negotiate the terms of termination of the labour contract again. You have been warned...
