New rules on family (re)unification from November 1, 2004

From the 1st of November 2004 the IND issued a new policy regarding the immigration of foreigners based on the right of family (re)unification.

The definition of family unification (gezinsvorming) exists when the relationship started with a Partner who lives in the Netherlands. Family reunification (gezinshereniging) exists when an other family member (like a child who wishes to live with its parents) starts to live together with a in NL family resident.

 

Since 1 November 2004 the age criteria for family unification (gezinsvorming) has been raised from 18 years of age to 21 years of age for each of the partners. Also the minimum netto income is raised from 100 percent to 120 percent (currently 1382,18 euro incl. financial holiday benefits).

For both 'gezinsvorming' as 'gezinshereniging' the sufficient income criteria is no longer a condition for single parents who have to take care of a child below 5 years of age. Also personen of 65 years of age and over do not have to proof the sufficient income anymore.

 

Persons who have come to the Netherlands as a minor and wish to start a family by bringing their spouses from another country do not longer have to wait a 3 year period.
